Athlete Participation Terms and Conditions

Applies to athletes ages 8–18 participating in any Cape Fear Beach Volleyball Club (“the Club”) program, training, or event.
By submitting this form, the athlete and their parent/guardian agree to all terms and policies outlined below.

1. PLAYER INFORMATION ACKNOWLEDGMENT

The athlete and parent/guardian certify that all registration information provided is accurate and complete to the best of their knowledge. The parent/guardian understands that the information will be used solely for communication, emergency contact, and internal Club operations.

2. WAIVER AND RELEASE OF LIABILITY

Participation in beach volleyball, conditioning, training, and tournaments involves inherent risks including, but not limited to, falls, collisions, dehydration, heat-related illness, and other potential injuries.

By submitting this form, the athlete and parent/guardian:

  • Voluntarily assume all risks associated with participation in any Club activity, whether at Club facilities, beaches, or other locations.

  • Release, discharge, and hold harmless Cape Fear Beach Volleyball Club LLC, its owners, coaches, staff, volunteers, affiliates, event organizers, sponsors, and facility providers from any and all liability, claims, demands, or causes of action arising from participation or presence at Club activities.

  • Understand that this waiver applies to any injury, illness, or property loss sustained while participating in Club-related events, whether caused by negligence or otherwise.

  • Agree to indemnify and defend the Club and its affiliates against any claims or costs arising from their participation.

This release is intended to be as broad and inclusive as permitted under the laws of the State of Florida.

3. MEDICAL CONSENT

The parent/guardian authorizes the Club’s staff or representatives to secure medical treatment deemed necessary in the event of injury or illness when reasonable efforts to contact the parent/guardian have failed.
The parent/guardian assumes full financial responsibility for any medical care and releases the Club and its representatives from any liability related to such care.

4. MEDIA RELEASE

The athlete and parent/guardian grant Cape Fear Beach Volleyball Club LLC unrestricted permission to use photographs, video recordings, or other media taken during Club activities for promotional, social media, or educational purposes without compensation.
This permission remains in effect until revoked in writing.

5. PAYMENT POLICY

The parent/guardian acknowledges and agrees to the following:

  • All tuition, training fees, and tournament costs must be paid according to the published schedule:

    • Pay in full at season start: 10% discount.

    • Pay in 3 equal payments: First payment due on day 1 of practice, 2nd and 3rd payment due on the 1st.

    • If siblings, 10% discount to each sibling.

  • Deposits and payments are non-refundable, except where required by law or if the Club cancels a program.

  • Missed practices, absences, or withdrawals (including for injury or scheduling conflicts) do not qualify for credits or refunds.

  • The Club reserves the right to suspend participation for delinquent payments.

  • Refund requests or special payment arrangements must be made in writing to Club management prior to the program start date.

6. CODE OF CONDUCT

To uphold the integrity of Cape Fear Beach Volleyball Club:
Athletes agree to:

  • Demonstrate respect toward coaches, officials, teammates, and opponents.

  • Maintain positive sportsmanship at all times.

  • Avoid profanity, bullying, or unsportsmanlike behavior.

Parents/Guardians agree to:

  • Support their athletes positively and respectfully.

  • Allow coaches to coach and refrain from negative sideline behavior.

  • Address concerns privately with Club staff at appropriate times.

Violations of this Code of Conduct may result in disciplinary action, suspension, or dismissal from the Club without refund.

7. CLUB POLICIES ACKNOWLEDGMENT

By registering, participants agree to abide by all Club policies, including but not limited to:

  • Attendance expectations for practices and tournaments.

  • Weather and cancellation procedures (the Club may cancel or reschedule for safety).

  • Equipment and uniform requirements.

  • Respectful behavior at all facilities, including rented courts and partner venues.

  • Acknowledgment that schedules, coaches, and locations may change as needed by the Club.

8. ASSUMPTION OF HEALTH AND COMMUNICABLE DISEASE RISK

The athlete and parent/guardian acknowledge that participation involves potential exposure to contagious illnesses (including COVID-19, influenza, and similar conditions). They voluntarily assume all related risks and agree not to attend practices or tournaments when experiencing symptoms or recent exposure. The Club may implement reasonable health or safety protocols as needed.

9. TRAVEL TEAM ADD-ON TERMS

For athletes participating in the Travel Team Program, the following additional terms apply:

Program Overview:
The Travel Team represents the highest level of training, competition, and college recruiting support offered by the Club. Participation includes advanced practices, performance workouts, and travel tournaments.

Travel Expectations:

  • Families are responsible for travel costs, lodging, and meals unless otherwise stated.

  • Athletes must maintain consistent attendance and communicate any scheduling conflicts early.

  • The Club reserves the right to adjust rosters, pairings, and tournament entries at its discretion.

  • Athletes represent Cape Fear Beach Volleyball Club and must adhere to all conduct standards at travel events.

College Recruiting Support:
The Club may assist with highlight reels, coach communication, and recruiting education. This does not guarantee college placement but provides structured guidance and exposure opportunities.

Acknowledgment:
By joining the Travel Team, athletes and families agree to the additional financial, time, and behavioral commitments associated with travel-level competition.

10. ACCEPTANCE OF TERMS

By submitting the Cape Fear Beach Volleyball Club registration form, the athlete and parent/guardian affirm that they have read, understood, and agree to all terms above.
Submission of the form constitutes a legally binding acceptance of these conditions for participation.
